The purpose of these general conditions of use (hereafter the “GCU“) is to provide a legal framework for provision of the website and for all information provided by CDCL Groupe S.A., CDCL S.A. and CDCL Promotions S.à r.l., and to define the terms and conditions of service access and utilisation by the User.

User” means any person using the website or any of the services offered on the website.

Unless specified otherwise, “Website” means www.cdclux.com. 

The GCU are accessible via the website on the page entitled “Legal notices“.

ARTICLE 1: Legal notices

The website www.cdclux.com is published by CDCL S.A., a Luxembourg limited company with share capital of 3,960,000 euros having its registered office at 24, rue Léon Laval, L-3372 Leudelange, RCS Luxembourg registration number B244953.

The hosting company of the the website www.cdclux.com is MIDORI S.à r.l., having its registered office at 72, rue des Près, L-7333 Steinsel.

ARTICLE 2: Website access

The website www.cdclux.com offers free access to the User, mainly to consultation services for real estate development projects currently being implemented.

The website may be accessed free of charge from any location by any User with internet access. All costs incurred by the User to access the services (IT hardware, software, internet connection, etc.) shall be borne by the User. 

ARTICLE 3: Intellectual property

All trademarks, logos, distinctive signs and content of the website (text, images, sound, etc.) are works protected by applicable laws on intellectual property.

CDCL is a registered trademark of CDCL Intellectual Properties S.à r.l. Any form of full or partial representation, reproduction or exploitation of the trademark is prohibited.

The User must seek prior written authorisation from the website publisher for any reproduction, publication or copying of the various content. The User undertakes to use the content of the website for strictly private purposes only – any use for commercial or advertising ends is strictly prohibited.

Any full or partial representation of the website by any process will constitute infringement punishable in law, unless with express authorisation from the website publisher.

Copying of the website for private purposes, notably including referral to the website or its content, is also prohibited, unless with prior written authorisation from CDCL S.A.

CDCL S.A. does not grant any right or licence relating to the website and its content, other than a non-exclusive licence to consult the website in its current form and at the User’s risk.

The sources of the information provided on the website www.cdclux.com are deemed to be reliable. However, the website cannot guarantee that they are free of error or omission.

Despite regular updates, the publisher of www.cdclux.com may not be held liable for any developments affecting administrative and legal provisions after publication of the website. Similarly, the website publisher may not be held liable for the utilisation and interpretation of the information contained on the website.

ARTICLE 7: Applicable law and competent court

The GCU shall be governed by Luxembourg law.

Any dispute relating to the application or interpretation of the GCU and or to utilisation of the website shall be submitted to the exclusive jurisdiction of the courts of the city of Luxembourg in the Grand Duchy of Luxembourg.
